Package Concierge® Terms and Conditions

Welcome to the Internet website of Package Concierge®, a division of Gibraltar Industries, Inc., on which these Terms and Conditions are posted. Package Concierge® is sometimes referred to herein as “Company,” “we,” “us,” or “our.”

Package Concierge® has developed technology to automate package management and provide subscribers 24/7 access to their packages (Services). These Services are provided under the trade name Package Concierge® and are described in greater detail on the Package Concierge® website. Further terms and conditions specific to use of Services can be found on the Package Concierge® app or in the resident portal.

Please read these Terms and Conditions (Terms) carefully and thoroughly before using www.packageconcierge.com or its social media platforms (Sites), as these Terms apply to all visitors, users, subscribers and others who access the Sites.

1. Acceptance of Terms and Conditions

By accessing and/or using packageconcierge.com, and/or all other websites and social media channels owned and operated by Package Concierge® (Sites), you acknowledge that you have read, understood, and agree to be bound by these Terms which form an agreement that is effective as if you had signed it. If you elect not to accept these Terms, please do not access or use the Site or any of its content.

Package Concierge® reserves the right, at its sole discretion, to alter or amend these Terms at any time and without prior notice, by posting a new version of this document on the Sites. In addition to any modifications of the Terms, we will also post a revised “Last Updated Date” at the top of these Terms for reference; therefore, you should periodically check the Terms for updates. Any changes to these Terms take effect immediately upon posting and apply to all access to and use of the Sites thereafter. By continuing to access or use the Sites after we have posted a Term modification, you are indicating that you agree to be bound by the Terms as posted. If you elect not to accept the modified Terms, please do not access or use the Sites or any of its content.

2. Age and Eligibility

The Sites are designed for use by persons 18 years of age or older. Those who are 13-17 years of age may visit, browse and use the information on the Sites, but may not submit any personal information to the Sites. By using the Sites, you represent and warrant to Package Concierge® that you are over 18 years old or have the permission of your parent or legal guardian to use the Sites and agree to these Terms. If you are under the age of 13 years old, you should not use the Sites.

3. Use of Sites

The content contained on the Sites, such as text, data, information, graphics, images, audio, video and other material, as well as the company name and logo, along with all other product logos, trademarks and services marks, domain name(s), tagline(s), organization, functionality, and user look and feel, collectively referred to as Content, is owned or controlled by Package Concierge® and is protected by United States and International copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Copying, distributing, transmitting, displaying, mirroring, modifying or otherwise using in any way any Content of these Sites without express written permission of Package Concierge® is strictly prohibited. Further, you may not decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from these Sites or materials.

Package Concierge® does grant you the limited permission to print pages of the Sites on a local printer for personal use and/or third-party reference for the purpose of specifying and/or ordering Package Concierge® products; and where the Site is configured, to enable the download of particular Content; you may download one copy of such Content to a single computer, provided the material is not modified and all copyright notices contained within the material is retained. Further, you may not use the Content in a manner that suggests an association with any of our products, services or brands.

The Content of these Sites is provided “as is.” Although Package Concierge® makes every attempt to ensure these Sites are as accurate as possible, the descriptions of products and services on these Sites do not create a warranty or guarantee regarding such products and services. Package Concierge® makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Sites or the information, products, services, or related graphics contained on these websites for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

Package Concierge® has made every effort possible to ensure the accuracy of all information and Content contained within these Sites. We reserve the right to correct inadvertent or typographical errors, inaccuracies or omissions – should they happen to occur – and to change or update information at any time without prior notice. In addition, descriptions and specifications contained on these Sites were in effect at the time it was created and may be subject to periodic updates. Package Concierge® reserves the right to discontinue products at any time or change specifications and/or designs without prior notice and without incurring liability.

These Sites contain links to other sites on the World Wide Web that are not owned or operated by Package Concierge®, but are provided as a convenience, and your use of these sites is at your own risk. Package Concierge® has no responsibility or liability with respect to information or materials located on such third-party sites. The inclusion of any link(s) does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep these Sites up and running smoothly. However, Package Concierge® takes no responsibility for and will not be liable for these Sites being temporarily unavailable at any time, for any period, for any reason.

Certain sections of these Sites require registration. It is a condition of your use of these Sites that all the information you provide is correct, current and complete. You further agree that all information you provide to register with these Sites, or otherwise including but not limited to through the use of any interactive features on the Sites, is governed by our Privacy Policy and you consent to all actions we take with respect to your information consistent with our Privacy Policy. By providing requested registration information, you further agree to receive periodic communications from Package Concierge®, unless you specifying by selecting the opt-out box, and we agree to allow you to download certain intellectual property such as, but not limited to, product specifications, marketing literature and technical documents, as well as the use of our exclusive online locker configurator and its output. We will not sell or distribute your registration information to anyone outside Package Concierge® and it will only be used so that you may access the restricted portions of these Sites as well as receive periodic communications from us. You may opt-out from these communications at any time while still maintaining access to the register only sections of these Sites.

Any information gained from registering on the Site will be stored and protected on a secure server which uses technologies generally used in the trade to prevent unauthorized access to data. Package Concierge agrees that it will treat such information as confidential and will restrict access to the data only to its employees and affiliates. You are responsible for restricting access to your computer and agree to accept responsibility for all activities that occur under your account and password. Package Concierge® reserves the right to terminate accounts or refuse orders at its sole discretion.

The owner of these Sites is based in the United States and has provided these Sites for use by persons located in the United States. We make no claims that these Sites or any of its Content is accessible or appropriate outside the United States. Access to these Sites may not be legal by certain persons or in certain countries, and if you access these Sites from outside the United States, you do so on your own initiative as we are not responsible for compliance with local laws in your area.

4. Rules of Conduct

Access to these Sites is limited to viewing the linked Web Pages for legitimate business purposes to access the information provided by Package Concierge® at these Sites. Any access or attempt to access other areas of the Package Concierge®, Florence Corporation, or Gibraltar Industries computer system(s) or other information contained on the system for any purposes is strictly prohibited.

You may not use any information on these Sites other than in connection with a legitimate business purpose. We hold a zero-tolerance policy for spam and spammers.

You may not use or attempt to use any engine, software, tool, agent, or other device or mechanism, including without limitation browsers, spiders, robots, avatars or intelligent agents to navigate the Site, other than the search engines and search agents available through the Site and generally available third-party web browsers. Further, you agree not to access the Site by any means other than through a standard web browser.

You may not post or transmit any message on these Sites which is libelous or defamatory, or which discloses private or personal matters concerning any person or business. You may not post or transmit any message, data, image or program that is indecent, obscene, pornographic, harassing, threatening, abusive, hateful, racially or ethnically offensive or that encourages conduct which would be considered a criminal offense, give rise to civil liability, violate any law, or that is otherwise inappropriate. Package Concierge® reserves the right to hide, block or otherwise remove any messages, posts or images that do not follow these rules of conduct.

You may not use these Sites in any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

You may not copy or use personal identifying or business contact information about other Users without their permission. Unsolicited e-mails, mailings, telephone calls, or other communications to individuals or companies whose contact details you obtain through these Sites are prohibited. Similarly, you may not impersonate or attempt to impersonate Package Concierge®, a Package Concierge® employee, customer or supplier.

You may not engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of these Sites, or which, as determined by us, may harm Package Concierge®, these Sites, or users of these Sites.

Additionally, you agree not to use these Sites in any manner that could disable, overburden, damage, or impair these Sites or interfere with any other party’s use of these Sites, including their ability to engage in real time activities through these Sites.

5. Disclaimer of Warranties

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Site will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures, technology, and checkpoints to satisfy your particular requirements for anti-virus and anti-intrusion protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DENIAL OF SERVICE ATTACK, A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT OR DAMAGE YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY INFORMATION OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

6. Liability Limitation

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

7. Entire Agreement

The Terms and our Privacy Policy constitute the sole and entire agreement between you and Package Concierge® regarding these Sites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding these Sites.

We welcome and encourage you to provide feedback, comments and/or suggestions for improvements to our Sites. You acknowledge and agree that all Feedback will be the sole property of Package Concierge® and you hereby irrevocably assign to Package Concierge® all of your right, title and interest in and to all Feedback.
